The graffiti artist known only as “Banksy” has publicly chastised Guess for profiting from his work without compensating him. He essentially invited all “shoplifters” to rob the store by posting a picture of it on London’s Regent Street. “Attention all professional thieves. Guess is accused of “Flower Thrower Graffiti” by Banksy

In the meantime, Guess has remained mute in the face of Banksy’s claims.
Is Guess Subject to Copyright Liability?
Banksy may have committed copyright violations, but he appears to have been swayed by too many subjective factors. The singer recently expressed his support for shoplifting, which is a criminal offence. As a result, Guess locked its doors and stationed guards in front of the storefront windows. They refused to even speak to the media, so even their own employees remained silent.
Guess’ chief creative officer, Paul Marciano, has been cited as saying, “Banksy’s graffiti has had a great influence that echoes across popular culture.” The fashion sector may express its gratitude with this new capsule collection created in conjunction with Brandalised.”
On the topic of copyright, Virtuoso Legal CEO Liz Ward agreed with Guess, noting that the company “seems to have properly sourced the Banksy artwork via a third party, notably Brandalised.” Brandalism has the “legal rights” to sell Banksy-themed merchandise. As a result, Banksy has no breathing space.
She stated they don’t know if Banksy was on board with the trade or even knew about it. If he was aware, his words could be used to launch a guerrilla marketing campaign. If he was unaware of it, he must be irritated, especially since such well-known companies and brands contradict his anti-establishment beliefs
Furthermore, even if he wished to legally bind Guess or Brandalised, her/his decision to remain nameless would prevent him from doing so. While copyright infractions are often considered civil offences, the attorney emphasised the seriousness of the case and the possibility of long-term commercial damage.
